Mr. Mochinski has been practicing law for well over 18 years as a sole practitioner, primarily in the areas of intellectual property law, environmental law, and construction law. He has extensive experience in preparing and prosecuting patent applications directed to chemical transport and metal recovery processes, gaming and vending systems operating under software control, electro-mechanical devices, nutritional products and supplements, medical devices, construction and machinist tools and implements, and novelty items, as well as preparing and negotiating an assortment of agreements relating to the transer and licensing of intellectual property rights (patents, copyrights, trademarks, and trade secrets). His experience extends to preparing and prosecuting applications for trademarks, conducting freedom-to-operate analyses and due diligence reviews, preparing patentability and infringement opinions, and serving as a legal advisor and expert witness in court proceedings and hearings involving intellectual property matters as well as in matters arising in the environmental and construction fields.
Prior to entering into the practice of law, Mr. Mochinski was employed by the Department of Defense and numerous engineering consulting firms as a consulting process/chemical engineer in the environmental field. Some of his duties were directed to designing and permitting remedial control processes for restoring hazardous waste sites under Superfund authority (CERCLA), managing hazardous waste streams to ensure compliance with the requirements under RCRA, and evaluating industrial waste streams for waste minimization opportunities. He has also been an invited speaker at numerous symposiums and conferences focusing on wastewater treatment processes and waste minimization techniques applied in the petrochemical and railroad industries. As a result of acquiring extensive engineering experience, Mr. Mochinski qualified for state licensure as a professional chemical engineer. Mr. Mochinski continues to hold his license as a professional engineer in the state of Minnesota concurrently with his standing as a licensed attorney in the state of Minnesota and as a registered practitioner before the United States Patent and Trademark Office. Mr. Mochinski is also an admitted attorney of the United States District Court for the District of Minnesota and United States Court of Appeals.
